W. Barry Montgomery is a partner in the Richmond office of Kalbaugh, Pfund & Messersmith. He actively practices in all levels of courts in the Commonwealth of Virginia and the state of West Virginia, as well as federal courts in Virginia, West Virginia and the 4th Circuit Court of Appeals. Mr. Montgomery has served as lead counsel over 50 jury trials and provided opinions and advice in countless employment, regulatory and insurance coverage issues. Mr. Montgomery also represents clients before various state regulatory boards and commissions. Mr. Montgomery’s practice covers professional liability, labor and employment law litigation, including Directors and Officers matters, tortuous interference, defamation claims and coverage issues. Mr. Montgomery counsels his clients on proactive and common sense approaches to employee relations in order to prevent claims while implementing aggressive yet practical strategies to litigation and, where appropriate, dispute resolution. Mr. Montgomery has represented clients in various employment related matters in both state and federal courts as well as various administrative agencies, including the Equal Employment Opportunity Commission and the Virginia Department of Labor and Industry. He represents clients in various types of employment discrimination claims i.e. race, age, gender under various federal and criminal statutes, including claims of retaliation in the workplace and sexual harassment. Mr. Montgomery also handles cases involving the FMLA as well as employment contract disputes and covenants not to compete or solicit. Mr. Montgomery regularly defends business tort claims defamation, interference with contract, business conspiracy and defamation. Finally, Mr. Montgomery has considerable experience in matters involving common law wrongful termination claims.
