New Battle Lines for Employment Claims

How will recent developments in the law regarding (1) obesity discrimination, (2) discrimination based on sexual orientation and sexual identity, (3) stereotypes regarding accused harassers, (4) overtime exemptions, and (5) independent contractor definitions affect claims? This presentation does not just address new developments in the past year in the area of employment law; the presentation analyzes the impact the new developments will have on employment claims going forward.

Dove A.E. Burns of Obermayer, Rebmann, Maxwell & Hippel, LLP in New Yorkfocuses her practice on employment law and professional liability. She has experience defending corporate clients and executives, professional service providers, multibillion-dollar international restaurant chains, hospitals, municipalities, housing authorities, nonprofits, and boards of directors in a variety of high-exposure matters.

Robert G. Chadwick, Jr. is a managing member of the law firm of Seltzer, Chadwick, Soefje & Ladik, PLLC. He has more than 35 years of experience representing management, fiduciaries and professionals in the areas of labor and employment law, ERISA investigations and litigation, and professional liability. He is Board Certified in Labor & Employment Law by the Texas Board of Legal Specializations. He is admitted to practice in state and federal courts in Texas and Georgia, the Fifth, Tenth, and D.C. Courts of Appeal, and the U.S. Supreme Court.
Hannah Stone, Esq. is a Shareholder with the Milodragovich, Dale & Steinbrenner law firm located in Missoula, Montana. Hannah has accumulated extensive experience in insurance coverage and extra-contractual claims defense ranging from personal injury and wrongful death claims to workers compensation and other employment and labor related issues. Hannah has obtained multiple favorable rulings for her clients through the Montana Human Rights Bureau, and most recently has been requested to mediate and speak on employment issues for local businesses. She is an active substitute Justice of the Peace in Missoula Justice Court. In 2019 Hannah was qualified by the federal court to testify as an expert witness on reasonableness of attorney fees in an insurance coverage declaratory judgment action.

Carrie L. Graziani, Esq., AIC, RPLU of Hanover Insurance Group in Itasca, IL is a Senior Specialty Claims Manager, specializing in Employment Practices, D&O, Fiduciary, and Cyber Liability claims involving Private Company and Non-Profit Insureds. Carrie manages a group of senior claims consultants in these areas, as well as personally handling a variety of management liability claims. Carrie received her Bachelor of Arts from Xavier University and her Juris Doctor from DePaul University College of Law. Carrie was a carrier-side coverage attorney in private practice prior to working for carriers.

Moiré L. Moron, Esq. is a licensed New York attorney with over five years of diverse legal experience and 14 years of insurance experience. Moiré joined QBE in May 2014. She is currently an Assistant Vice President – Employment Practices Liability Claims Practice Leader for Management Liability, handling EPL and D&O matters.

Prior to joining the insurance sector, Moire served as an executive advisor to various government officials in the Virgin Islands, including the Governor of the Virgin Islands’ Chief Legal Counsel and the Solicitor General. She was instrumental in revising and drafting key legislation for the Territory, including the Territory’s Labor Relations statute. She also served as a Judicial Law Clerk for a Senior Judge of the Superior Court of the Virgin Islands, where she independently authored several judicial opinions that were published in the Virgin Islands Reports, and which are now used as precedent.
