Everyone knows the significance of access to expert witness backgrounds in professional liability litigation. Ready access to quality forensic witnesses for professional liability defendants at trial is often vital to success. Similarly, access to impeachment information about plaintiffs’ expert witnesses can also be vital to success. Opinion reports, affidavits and deposition or trial transcripts of such witnesses from other E&O cases can be of great value in forensic witness selection decisions, in preparing one’s own witnesses for cross-examination, and in preparing for cross-examination of plaintiff’s witnesses.
Absent coordination, key expert information may remain lost in closed files or discarded. Although many courts require disclosure of prior testimony of parties’ experts in discovery, easy access to useable information from such a disclosure often yields mixed results. The Professional Liability Defense Federation’s™ solution to this problem is its password protected centralized data base under development for professional liability case expert witness background information. Members are encouraged to forward reports, affidavits, and key transcripts to PLDF for uploading into our searchable data base. We expect to launch our expert resources program in 2012.
