Nursing Home Regulation Does Not Create Tort Duties

In Bedell v. Williams, 2012 Ark. 75 (February 23, 2012) the Arkansas Supreme Court, following Louisiana precedent, ruled that a nursing home regulation designed to assure Medicare/Medicaid participation did not create a standard of care affecting an administrator’s tort liability, and thus a verdict against the administrator was reversed on appeal.
