Overview of the Committee's Focus:

Employment litigators specialize in the statutory, regulatory and common law morass of challenges facing human resource management affecting both for-profit and non-profit employers.  These claims are viewed increasingly as a form of professional liability. Causes of action may allow for recovery of claimants' attorneys fees that magnify claim values and leverage negotiations, often unreasonably.  Class action risks, federal and state regulator scrutiny, Equal Employment Opportunity Commission oversight, adverse publicity, administrative law complexity, jury animus, and office environment disruption require state of the art competency by legal advocates and counselors representing management. Members of the PLDF EPL Claims Committee concentrate their practices on the defense of these and other claims:

• Wrongful Termination                                                                                  

• Sexual Harassment

• Discrimination

• Breach of Contract

• Wage and Hour Law Violations

• Whistleblower Reprisal

• Invasion of Privacy, Defamation, and Infliction of       Emotional Distress

The claims may arise from Title VII of the Civil Rights Act of 1964, the Civil Rights Act of 1991, the Americans With Disabilities Act, the Age Discrimination in Employment Act of 1967, the Equal Pay Act of 1963, the Family and Medical Leave Act, National Labor Relations Act, Genetic Information Nondisclosure Act of 2008, Fair Labor Standards Act, and allied state and local legislation.  Add to that panoply new claim exposures presented by medical marijuana, same sex marriage, workplace accommodations, transgender discrimination, and other evolving developments, and the EPL specialist is busy.

PLDF's EPL Committee members focus their committee involvement on best practices for claim avoidance strategies, client policy and procedure enhancement, litigation hold management, marshaling proof of employer defenses, EEOC procedure competency, employee review and performance deficit documentation, imprudent adverse action prevention, and for other defense preparations.  Fluency in today's federal and state court case law developments is also vital to the EPL defense specialist and we expect that the EPL community within PLDF will connect and share information important to the successful defense of cases.   

Committee members are asked to contribute to article publication, to monitor the PLDF news and respond to member inquiries for assistance, and to assist in annual meeting seminar presentation planning.
